Notice of Understanding and Intent and Claim of Right

Addressed To:

Barack H. Obama, Jr., the man acting as President of the United States of America;

Eric H. Holder, Jr., the man acting as Attorney General for the United States of America;

Donald B.Verrilli, Jr., the man acting as Solicitor General for the United States of America;

Jeff Tate, the man acting as Chief of Police of Shakopee, Minnesota; Kevin Studnicka, the man acting as Sheriff of Scott County, Minnesota;

Dear Sirs:

I am serving herewith, my Notice of Understanding and Intent and my Claim of Right and my Notice of Denial of Consent, all for your mutual understanding. You will find the enclosed writings to be intact and complete, for now. I am sending this NOTICE out as a courtesy in order to avoid any further confusion or potential conflict. I am now expanding the reach of my discourse in order to maintain my honor and ensure maximum clarity between myself and all agents within American government agencies.

After receiving this NOTICE, please notate your records regarding my Notice of Understanding and Claim of Right and my Denial of Consent and Fee Schedule in order to ensure maximum clarity amongst all parties.

As a peace loving and unarmed man, desiring to avoid conflict and to live lawfully with maximum freedom, I have recently been studying the history of the United States along with its legal system by using educational content provided on the Internet at many various web addresses such as www.annavonreitz.com, www.edrivera.com and worldfreemansociety.org. I have since come to some very interesting conclusions that I am now applying within my life.

After reading various Legislative or Executive Acts and exploring the way language is used in those Acts, I have realized that the words “lawful” and “legal” have different meanings. It also appears that all acts and statutes in the United States are only contracts based in Commerce. Therefore I am now contacting the various government officials named above in the hopes that someone can either confirm or correct my understanding. If you do choose to respond with corrections, I require that you do so within Fourteen (14) days of service of this NOTICE, in writing, via registered mail and provide proof of your claim, under oath or attestation with full commercial liability and penalty of perjury. A lack of response or response that does not contain proof of my mistaken understanding, on a point-by-point basis, will be assumed to imply agreement with my understanding. Failure to dispute the claims made herein will result in an automatic default judgment and permanent and irrevocable estoppels by acquiescence.

Now, specifically in the United States I understand that there is both a common law and statute law tradition, which is interesting, because I also understand that a statute is a legislated rule of a society, which has the force of law upon members of that society; a society being a fictional legal entity such as a corporation.

I also understand that the Government of the United States is not a nation as I thought it was, occupying a geographical location, but instead merely a corporation with de-facto authority, rather than lawful. This corporation can only make corporate/contract law that has the force of law only upon its consenting members.

From my research, the “law of the land,” is the peaceful common law, which is not influenced by acts and statutes. Under common law, the rights, freedoms, and duties of private individuals have long been established and unlike statute law, common law has had a progression towards more freedom and personal responsibility rather than less.

Among the rights and freedoms understood by common law are such things as the rights to life, liberty, the pursuit of happiness, property and use thereof, privacy, peace, and the ability to travel freely in public without harassment or intimidation. The obligations and duties of those living under common law are essentially to ensure that one does not infringe or allow others to infringe upon those unalienable rights and freedoms granted to man by our creator.

I have also learned that the rights of a free spiritual being cannot be lawfully limited without consent, as that would imply slavery. Effectively, rights are not bestowed upon one by another unless the first gives his/her consent, or the first is the lawful property of the second. The very nature of the concept of consent is that it can only exist amongst equals with full disclosure and without coercion.

I do not recall ever being sold or purchased as a slave, nor do I recall giving my free consent to be governed or represented by any governmental agent, although at times I have been deceived and intimidated into submission at such places as the Department of Motor Vehicles.

Although the various rights and freedoms are self-evident and unalienable, in order for lawful representation to exist, there must be mutual consent, and that consent may be revoked for any reason depending on the nature of a specific contract between the two parties.

I am hereby notifying all who read this and any other interested parties that I have revoked my consent to be governed by fictitious corporate entities with which I do not have a subsisting contract. I declare that I am neither a child nor a slave, but a free man capable of administering my own affairs.

It is further my hope to teach government workers that Government doesn’t know the limitations of its written law, because it does not know, does not understand, and does not appear to be applying the entire Organic Law of the United States of America to daily operations.

Affidavit - Notice of Understanding and Intent And Claim of Right

I, a natural flesh and blood living soul without subjects, commonly known as James-Allen of the Homyak family, living on a geographical area commonly referred to as North America and near the Scott County Minnesota townships and cities commonly known as Shakopee and Prior Lake, and parts of the Wyoming republic, having no corporate status, do hereby state under oath that the following is my Truth and my Law.

Whereas:

It is my understanding that:

The only and true jurisdiction that Man can be part of is the one from his creator: Life. Life is also known as the Universe, God, the Source, Nature, Nature’s God, Love or the Creation. Life is self aware and speaks to itself through the Heart, and;
The only Laws that apply to Man are the Laws of Creation also known as the Divine Laws, the Laws of Nature, the Laws of Love or the Laws of the Universe and those Laws are written into the Heart of Man, and;
I am a common Man, but not a “person” or “subject” as defined in state statutes and;
Any system of laws that are not of Life are of man, and;
The only jurisdiction to which I willfully and completely consent is the one from within my own Heart and I call it Love, and;
Out of necessity, compassion, love and to the best interest of peace for all of those who believe that only the laws of man exist and apply to all, I allow myself to be seen by systems created by man through the different interfaces that those systems provide without, nevertheless, me consenting to their jurisdiction over me, and;
A natural common Man is born out of Love whereas a corporation is born out of money. It is therefore impossible for a Man to give or receive money since the only thing a Man can give or receive is Love, and;
All the people living upon the geographical area commonly referred to as central North America, i.e. the United States, enjoy the protection of the English Common Law, and;
Equality before the law is paramount and mandatory, and;
The law/maxim of agent and principal applies, therefore, service upon one is service upon both, and;
Acts are statutes restricted in scope and applicability by the written Organic Laws of the United States (Declaration of Independence of July 4, 1776; Articles of Confederation of November 17, 1777; Northwest Ordinance of July 13, 1787; U.S. Constitution of September 17, 1787), and;
A statute is defined as a legislated rule of society which has been given the force of law, the color of law, and;
A society is defined as a number of people joined by mutual consent to deliberate, determine and act for a common goal, and;
For something to exist legally, it must have a name, and;
The Law Societies and Bar Associations of North America are the ones who create the statutes and therefore they are applicable only to their members and to those that consent, and;
The only form of government recognized as lawful in the area commonly referred to as North America is a representative one, and;
All governments today are corporations which provide enumerated services, and;
All governments and corporations, including all of their agents, are bound by the full written Organic Law of the United States, and;
Representation requires mutual consent, and;
In the absence of mutual consent neither representation nor governance can exist and;
Those who have a SSN (Social Security Number) are in fact presumed to be employees of the federal government and thus are bound by the statutes created by the federal government, for its employees, and;
It is lawful to abandon one’s SSN, and have collected funds returned, and,
People living on the geographical area commonly referred to as the United States have the right to revoke or deny consent to be represented and thus governed, and;
If anyone does revoke or deny consent they exist free of government control and statutory restraints, and;
A Free Inhabitant of the Many States is one of natural flesh and blood who has lawfully revoked consent and does exist free of statutory restrictions, obligations, and limitations, and;
I, known as James-Allen: Homyak, am a free man on the Land, and;
Acting peacefully within common law standards is not unlawful, and;
All transactions of security interests require the consent and signature of both parties, and;
Any action for which one can apply and receive a license must itself be a fundamentally lawful action, and,
I, known as James-Allen: Homyak, a “free man on the Land” who operates with full responsibility am not a child of the State. I do not need to ask permission to engage in lawful/legitimate and peaceful activities, especially from those who claim limited liability, and;
Peace officers have two roles, first as peace officers and secondly as public policy enforcement officers (also known as police officers) and that the latter acting against a free man on the Land is in fact breaking the Law, as a Color of Law offense, and;
A by-law is defined as a rule of a corporation, and;
Corporations are legal fictions that require contracts in order to claim authority or control over other parties, and;
For any party to be justified to order payment from another party, there must be a valid contract, and;
I can use a Notary Public to perform duties found under any Act. Thus they have the power to hold court and hear evidence and issue binding legal judgments, and;
If the Notary fails in their Duty, then they have abandoned their post, and;
Personal and/or private property is defined as any thing lawfully in the possession of some one, and;
I have a right to use my personal property without having to continually or annually pay any fee or excise to any entity for the use or enjoyment of it, and;
I have an unalienable right to travel freely over the common ways using any modern mode of safe efficient travel including the use of my two white vans, ser no 1GNDM19WXYB115005 and 1GNEL19W5YB138196 and;
No one is obliged to have a LEGAL NAME or to give it freely to anyone demanding it, and;
I have a right to claim a limited amount of acres that I will judge appropriate and fair, of uninhabited land anywhere on the geographical area commonly referred to as the United States, and;
A “free man on the Land” can travel freely within the United States, and;
Use of the words “driver” and “motor vehicle” apply to employees hired to perform a function of transporting government employees, commercial persons and/or their property, and;
A summons is merely an invitation to attend and the ones issued by the United States or any of its agencies creates no obligation or dishonor if ignored, and;
Peace officers have a duty to distinguish between legislative statutes and Public Law and those who attempt to enforce statutes (color of law) against a “free man on the Land” are in fact breaking the law, (subject to Title 18 fines, prison and/or death penalties) and;
I have the power and right to refuse any transaction or interaction with peace officers, law enforcement officers or government agents/employees who have not observed me breach the peace or trespass against the rights of other living beings, and;
Breach of peace is defined as intentionally, physically hurting another human being or intentionally damaging someone else's personal property or committing any kind of unlawful action in a contract, and;
Permanent estoppels by acquiescence barring any peace officer or prosecutor from bringing charges against a “free man on the Land” under any Act is created if this claim is not responded to in the stated fashion and time mentioned hereunder, and;

Therefore be it resolved and known to any and all concerned and effected parties, that I, known as James-Allen: Homyak, a “free inhabitant on the Land”, do hereby state clearly, specifically and unequivocally my intent:

To peacefully and lawfully exist free of all statutory obligations and/or restrictions, and maintain all rights at law to international trade, exchange or barter, and;
To travel peacefully and lawfully on the geographical area commonly referred to as the United States by whatever means I deem necessary, and;
To be a steward of the land and waters of the geographical area commonly referred to as the United States including the land to which I lay claim, and;
To not pay taxes, for the collection of taxes is a function of government and with my denial of consent I will free myself completely from all governing bodies, agencies and institutions, and;

Furthermore I claim:

That these actions are not outside my neighbor’s standards and will in fact support said neighbors in our common desire for truth and maximum freedom, and;
The right to engage in these actions and further claim that all personal property held by me is held under a Claim of Right, and;
The right to, at any time, appoint peace officers to protect me and/or my personal property from anyone who would attempt to disturb or otherwise interfere with it, and;
That anyone, their principals or their agents who interfere with my lawful activities after having been served notice of this claim and who fail to properly dispute or make lawful counterclaim is breaking the law, cannot claim good faith or color of right and that such transgressions will be dealt with in a properly convened court de jure, and;
That the courts in the United States are de facto and are in fact in the profitable business of conducting, witnessing and facilitating the transactions of security interests and I further claim they require the consent of both parties prior to providing any such services, and;
That my consent to perform on any statutory obligation can only be granted by a written, signed and Notarized document, as my express reservation of rights do prevail, and;
That I do hereby deny consent to any transactions of a security interest issued under any Act for as herein stated as a “free man on the Land” I am not subject to any Act, and;
The unlimited right to travel freely and unmolested throughout the geographical area commonly referred to as North America, upon the territories known commonly as Montana, Wyoming, Idaho, Colorado, Kansas, Oklahoma, Arkansas, Nebraska, South Dakota, North Dakota, Minnesota, Iowa and all surrounding realms of the continent and that evidenced perfection of this Claim will act as sufficient documentation for entry and travel to and upon the geographical area commonly referred to as North America, upon the territories known commonly as Montana, Wyoming, Idaho, Colorado, Kansas, Oklahoma, Arkansas, Nebraska, South Dakota, North Dakota, Minnesota, Iowa and all surrounding realms of the continent, and;
The right to enjoy the unmolested pursuit of my activities and free use of the streets, avenues, highways and public roads, and;
The free, exclusive, unlimited and unrestricted right to use my personal property, and;
The right to direct my life and all of my activities the way I see fit, and;
The right to generate lawful excuse, which is a general term, which includes all of the defenses which the common law considers sufficient reason to excuse a flesh and blood common man from criminal liability, and;
The right to claim an area of uninhabited land anywhere in the geographic area commonly referred to as the United States, and;
The right to deregister anything that has been registered by me, and;

Notice of My Fee Schedule:

The right to establish for me or any one under my care a FEE SCHEDULE for any transgression(s) against me, my family or any one or any thing under my care that is or are perpetrated by peace officers, government principals, agents or justice system participants, those fees being FIVE HUNDRED DOLLARS ($500.00) PER HOUR or portion thereof if being questioned, interrogated or in any way detained, harassed or otherwise regulated, and TWO THOUSAND DOLLARS ($2,000.00) PER HOUR if handcuffed, transported, incarcerated or subjected to any adjudication process without my express written and Notarized consent, and a minimum of FIVE MILLION DOLLARS ($5,000,000.00) for any violence brought against me, my family or any one under my care, and TEN THOUSAND DOLLARS ($10,000.00) PER DAY if any personal property is being taken away from me without my express written and Notarized consent, and;
The right to be awarded full replacement cost/payment for any of my property damaged or destroyed through the actions of any government persons or agents, and;
The right to choose a lawful method of payment upon demand, and;
The right to use a Notary Public, commissioner or any two (2) people not related to me by blood or marriage to secure payment of the aforementioned FEE SCHEDULE against any transgressors who by their actions or omissions harm me or any one under my care or my interests, directly or by proxy in any way, and;
The right to engage the services of a Notary Public or commissioner for taking affidavits and/or any two (2) people not related to me by blood or marriage to attest to my signature for verification purposes, and which does not constitute adhesion, contract or change in status in any manner, and;
The right to convene a proper court de jure in order to address any potentially criminal actions of any peace officers, government principals or agents or justice system participants who having been served notice of this claim fail to dispute or discuss or make lawful counterclaim and then interfere by act or omission with the lawful exercise of properly claimed and established rights and freedoms, and;
The right to provide for myself or any one who wants it, any service provided by the territorial Governments (civil and/or municipal) of the United States;
The right to use any service provided by the Government of the United States that I deem necessary without it affecting my status as a “free inhabitant on the Land”, and;
The right to keep and use as I see fit any and all inheritances given to me, and;
The right to determine what is best for me, my family and anyone under my care, and;
The right to govern myself accordingly, and;
The right to deal with any counterclaims or disputes publicly and in an open forum using discussion and negotiation and to capture on video or audio tape said discussion and negotiation for whatever lawful purpose as I see fit, and;
The right to refuse any service or intervention by any level of government, and;
The right to have, in the event of my death, all of my personal property and inheritances that I pass on, protected by this Claim and that my Will is my final word.

Directions for Response:

Affected parties wishing to dispute the claims made herein or to make their own counterclaims must respond appropriately within FOURTEEN (14) DAYS of service of notice of this action. Responses must be under Oath or attestation, upon full commercial liability and penalty of perjury and registered in the notary's office herein provided no later than FOURTEEN (14) DAYS from the date of original service as attested to by way of certificate of service, and;
Failure to register a dispute against the claims made herein will result in an automatic default judgment securing forevermore all rights herein claimed and establishing permanent and irrevocable estoppels by acquiescence forevermore barring the bringing of charges under any statute or Act against myself a “free man on the Land” known as James-Allen of the Homyak family, and;
Use of a notary is for attestation and verification purposes only and does not constitute a change in status or entrance or acceptance of foreign jurisdiction.

Notice of Denial of Consent

Whereas:

American Nationals, aka Free Inhabitants of the United States enjoy a common law jurisdiction, and;
Equality before the law is paramount and mandatory, and;
In a common law jurisdiction no one can claim the right or power to adjudicate any matter without the consent of both parties, and;
Without my consent, no lawful adjudication concerning myself may occur, and;
I do hereby, claim this right unalienable by any government agent to engage in discussion either directly or through an agent prior to consenting to any adjudication or administrative or military tribunal or other process which may generate a security interest, and;
I do claim said right has been denied to me by human beings (various men and women) acting as government agents in a common law jurisdiction, and;
I do hereby, re-extend my offer of discussion and negotiation in order to avoid conflict, and;
Seeking conflict as a government agent in a court of law in the absence of discussion or negotiation is a denial of basic fundamental rights, a dishonor, and an abuse of process, bordering on the commission of the crimes or personage and barratry, and;
Said dishonor, denial and abuse does cause the administration of justice to appear to be dragged into disrepute, and;
I am compelled by my honor and Faith to refuse to be party to any action which may be seen to drag the administration of justice into disrepute, and;
I do believe the path of peace is always available to those of good will, and;
I am peaceful and of goodwill, and;
I do believe peace is a fundamental right to be protected and the basic justification for government to serve in protecting such right, and;
Consenting to an adversarial relationship in the absence of good faith discussion and negotiation is a breach of my Faith, and;
Abuse of the judicial process and forcing me to breach the terms of my Faith is completely unacceptable to me,

Therefore be it resolved and known to any and all concerned:

That I, a natural living man in a common law jurisdiction, in no way consent to any adjudication process of any sort by any party and that said denial of consent remains in force until any plaintiff or claimant honors the existing offer to discuss and negotiate in good faith and pure trust and under full commercial liability. This notice is served in the interest of justice, without malice of forethought, without ill will, without vexation or frivolity and suffices as notice of a claim by the Affiant that a plaintiff or claimant is apparently abusing process for financial or other gain and thus causing the administration to be dragged into disrepute.

I, Allen-James of the Homyak family, formerly expected to stand in commercially and in equity as James A. Homyak, (Jim or Jimmy) of Brooklyn Park, Minnesota and hereinafter I claim my American National and free inhabitant political status along with a revision of my name,

Now therefore, as of the year of our Lord 2009, with the exclusion of all former names, locations and commercialisms, I shall now be known as, Allen-James: of the Homyak Family; also Jim: of the Homyak family; also Jimmy: Homyak; and furthermore any nickname I choose to associate with casually and sometimes at random.

As such, I claim to be a common man, a flesh and blood human being in possession of a sovereign and individual spirit, a living soul, who hereby makes Oath and state the following is My Truth and My Law:

[010] Whereas it is my understanding that in terms of earthly existence there is no species more supreme than a living, breathing, imaginative human being blessed with a living soul and a conscious awareness, and

[020] Whereas it is my understanding that it is impossible to distinguish one soul from any other, and therefore all souls must at all times and in all situations be considered equal in all respects in any fair, just and reasonable context, and

[030] Whereas it is my understanding that anything and everything must in practice derive from the aforesaid axioms, and

[040] Whereas it is my understanding that any numerical grouping of such souls can be referred to as 'people', and

[050] Whereas it is my understanding that a society is, in essence, nothing more than a grouping of like-minded souls since it is defined as a number of people joined by mutual consent to deliberate, determine and act for a common goal, and

[170] Whereas it is my understanding representation requires mutual consent, and

[180] Whereas it is my understanding that upon the absence of mutual consent neither representation nor governance can exist, and

[190] Whereas it is my understanding the United States of America is a Common Law jurisdiction enjoying the protection of Common Law, and

[200] Whereas it is my understanding equality before the law is paramount and mandatory, and

[210] Whereas it is my understanding that for something to exist legally it must have a LEGAL NAME created administratively, and

[220] Whereas it is my understanding that the UNITED STATES OF AMERICA is in reality a corporation in Chapter 11 bankruptcy and thus still allowed to trade, and

[230] Whereas it is my understanding that by virtue of my birth within the boundaries of my Country Minnesota I am a single share owner in said UNITED STATES OF AMERICA CORPORATION, and

[240] Whereas it is my understanding all Acts are statutes restricted in scope and applicability by the American Constitution and Common Law, and

[250] Whereas it is my understanding a statute being defined as a legislated rule of a society is, within the United States of America, in fact a rule of said UNITED STATES OF AMERICA CORPORATION, (a WASHINGTON DC MUNICIPALITY) and

[260] Whereas it is my understanding rules of a corporation are limited in applicability to those who are agents of said corporation, and

[270] Whereas it is my understanding those who knowingly utilize a National Insurance Number are in fact employees (aka merchant marines) of the government and thus are bound by the statutes created by the said government, and

[280] Whereas it is my understanding that it is lawful to abandon one’s National Insurance Number while at the same time not affecting the right to any pension claim based on National Insurance Contributions previously paid, and

[290] Whereas it is my understanding people in the United States of America have a right to revoke or deny consent to be represented and thus governed, and

[300] Whereas it is my understanding if anyone does revoke or deny consent they exist free of government control and statutory restraints, and

[310] Whereas it is my understanding that a claim of right establishes a lawful excuse, and

[320] Whereas it is my understanding that if one has lawful excuse one may choose to not obey a court, tribunal, statute, Act or order, and

[330] Whereas a Freeman-on-the-Land has lawfully revoked consent and does exist free of statutory restrictions, obligations, and limitations, and

[340] Whereas it is my understanding that I, Allen-James: Homyak as a Freeman-on-the-Land in practice and a free inhabitant as presented in the Articles of Confederation for the United States of America, or like a sporting athlete in free agency status, acting peacefully within community standards, would not in that capacity breach the peace, and

[350] Whereas it is my understanding that all existing courts and governments are de facto only and not de jure, and

[360] Whereas it is my understanding that a man acting as Barack Obama did take the Oath of Office of Washington DC President of the United States on the Twentieth Day of January, Two Thousand and Nine, and

[370] Whereas it is my understanding that during an Inauguration ceremony said man acting as Barack Hussein Obama was asked by a man acting in the role of the Chief Justice of the Supreme Court to recite the Oath of Office and he responded "I, Barack Hussein Obama, will faithfully execute the Office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States, so help be God.", and

[380] Whereas it is my understanding that this ceremony did install said man as President of the United States of America, and

[390] Whereas it is my understanding that on or after the Seventeenth Day of October Nineteen Hundred and Seventy Two said woman did sign into statute an Act of Parliament known as the European Communities Act of Nineteen Hundred and Seventy Two (ECA1972) which accepted without my consent a treaty known as the Treaty of Rome, and

[400] Whereas it is my understanding that the terms of the Treaty of Rome are counter in many respects to the “respective laws and customs” of those nations of which said woman is President including England which is my Country of birth, and

[410] Whereas it is my understanding that anyone who participates in allowing or by culpable neglect enabling my Country to be governed in any way by any foreign power is an act of treason as defined by the United States Constitution, and

[420] Whereas it is my understanding, therefore, that by signing of the ECA1972 as opposed to dissolving by Royal Prerogative the Parliament that created the treacherous Act was in itself by collusion an attempted act of treason against my Country, and

[430] Whereas it is my understanding that as a free-man-on-the-Land in this common law jurisdiction that I have the duty among the people to stand as the militia in defense of the United States of America and its people against foreign armed troops who attempt to invade, govern or police me or my Country, and

[440] Whereas it is my understanding that this duty is not affected by agreements made by treasonous and de facto government agents, and

[450] Whereas it is my understanding that agreements made on behalf of the United States of America by traitors to the United States of America do not bind the people of United States of America, and

[460] Whereas I do firmly and truly believe the aforementioned agreement is an overt act of treason, and

[470] Whereas I honorably refuse to be bound by agreements made by traitors such as said Barack Obama in collusion with the then House Speaker Nancy Pelosi, and

[480] Whereas it is my understanding that any peace officer who co-operates with foreign armed troops to govern or regulate the population is also committing treason, and

[490] Whereas it is my understanding that historically the purpose of a national armed force was to ensure that foreign powers never invaded and governed under a gun, and

[500] Whereas it is my understanding that the existence of armed foreign troops patrolling and policing our streets would be evidence of a war fought unsuccessfully, and

[510] Whereas it is my understanding that agreeing or conspiring to agree to allow armed foreign troops to patrol and police our streets is an act of treason, and

[520] Whereas it is my understanding that any action for which one can apply for and receive a licence must itself be a fundamentally lawful action, and

[530] Whereas as I am not a child and I am a Freeman-on-the-Land who operates with full responsibility and I do not see the need to ask permission to engage in lawful and peaceful activities, especially from those who claim limited liability, and

[540] Whereas it is my understanding that I have a right to use my property without having to pay for the use or enjoyment of it, and

[550] Whereas it is my understanding that all ‘public transportation' is in fact and actuality public property to which I have the right of use and access without having to pay, and

[560] Whereas it is my understanding peace officers have a duty to distinguish between statutes and law and those who attempt to enforce statutes against a Freeman-on-the-Land are in fact breaking the law, and

[570] Whereas it is my understanding that I have the power to refuse intercourse or interaction with peace officers who have not observed me breach the peace, and

[580] Whereas it is my understanding that permanent estoppel by acquiescence barring any peace officer or prosecutor from bringing charges against a Freeman-on-the-Land under any Act is created if this claim is not responded to in the stated fashion and time, and

[590] Whereas it is my understanding that the Common Law right to travel on the highways without license provided one is not engaging in commerce thereupon is lawful and still exists although it does appear to have been deceptively hidden, and

[600] Whereas the Road Traffic Acts of the United States of America do make it possible for peace officers in the role of policy enforcement officers to stop an automobile in order to provide services and demand something of value, and

[610] Whereas it is my understanding that if they are not providing a service they have no reason to stop any one and if proof of registration, insurance and license is not valuable they have no need to ask for it, and

[620] Whereas it is my understanding that I have the right to refuse to interact or co-operate with criminals, de facto government agents or grossly negligent peace officers, and

[630] Whereas it is my understanding that if I have the power to elect a representative and empower them to appoint peace officers then I also have the power to appoint directly, and

[640] Whereas it is my understanding that if I have the power to appoint directly or by proxy I must have the power to fulfill those duties myself, and

[650] Whereas it is my understanding that the United States of America Police Force although having an illustrious history has had members recently acting in a grossly criminal manner which does tarnish the previous history and record, and

[660] Whereas it is my understanding that the Law provides remedy at all times, even against rogue or negligent peace officers and de facto governments apparently hijacked by soulless corporate interests, and

[670] Whereas it is my understanding that in order to be a peace maker and deal with rogue and possibly armed police officers who fail to act with respect to the code of Common Law I will need use of and access to firearms of equal or greater power then those people who act criminally have access to, and

[680] Whereas it is my understanding that the act of registering the birth of a baby creates a legal entity called a person that exists in association with that baby and that the manner in which offspring are registered transfers superior guardianship rights over that offspring to the government, and

[690] Whereas it is my understanding that this creation of a person and transfer of authority is not fully disclosed to the parents and if it was all good parents would refuse to register their offspring, and

[700] Whereas it is my understanding that the person and the human being to which it is associated are two very separate and different things and that the people playing roles in government only have the right to act upon the person, and

[710] Whereas it is my understanding that if I do not exist in association with a person I cannot be lawfully governed by the people playing roles in government, and

[720] Whereas it is my understanding a by-law is defined as a rule of a corporation, and

[730] Whereas it is my understanding corporations are legal fictions and require contracts in order to claim authority or control over other parties, and

[740] Whereas it is my understanding that a summons is merely an invitation to attend and those issued by the Ministry of Justice or its franchises which are de facto corporations create no obligation or dishonour if ignored, and

[750] Whereas it is my understanding legal fictions lack a soul and cannot exert any control over those who are thus blessed and operate with respect to that knowledge as only a fool would allow soulless fictions to dictate one’s actions, and

[760] Whereas it is my understanding that the people in the government are merely playing roles, and

[770] Whereas I AM NOT PLAYING, and

[780] Whereas it is my understanding that I am not obliged to obey the orders of any one claiming to be a President or King or those acting on behalf of such an insane entity, as no one who does make preposterous claims that abandon and erode the concept of equality has any authority over me, and

[790] Whereas it is my understanding that I can use a Notary Public to perform duties found under any Act including thus they have the power to hold court and hear evidence and issue binding lawful judgments, and

[800] Whereas it is my understanding that a Notary Public can also be used to bring criminal charges to bear against traitors, even if they hold the highest office, and

[810] Whereas it is my understanding that there may be more of this to follow

[820] Therefore be it now known to any and all interested, concerned or affected parties, that I, Allen-James: Homyak (aka James Allen or Allen James of the Homyak family)[not a U.S. federally created Citizen resident statutory person] am a independent free inhabitant of this part of planet Earth and do hereby serve notice and state clearly specifically and unequivocally my intent to peacefully and lawfully exist free of all statutory obligations, restrictions and that I maintain all rights at law to trade, exchange or barter and exist without deceptive governance and to do so without limitations, restrictions or regulations created by others and without my consent.

[830] Be it also now known to any and all interested, concerned or affected parties, that I, Allen-James: Homyak as a Freeman-on-the-Land and do hereby serve notice and state clearly specifically and unequivocally that I would never conspire nor would I in any way entreat others to disobey the Common Law of the Land which ensures peaceful co-existence.

[840] Furthermore, I claim that these actions are not outside my communities’ standards and will in fact support said community in our desire for truth and maximum freedom.

[850] Furthermore, I claim the right to engage in these actions and further claim that all property held by me is held under a claim of right.

[860] Furthermore, I claim that anyone who interferes with my lawful activities after having been served notice of this claim and who fails to properly dispute or make lawful counterclaim is breaking the law, cannot claim good faith or colour of right and that such transgressions will be dealt with in a properly convened court de jure.

[870] Furthermore, I claim it is my right and solemn duty not only to keep the peace My Self but also to intervene wherever may be necessary to ensure that the peace is kept in a situation where peace officers are not present or are unwilling for whatever reason to uphold their sworn and solemn duty so to do.

[880] Furthermore, I claim that the identity of My Self is forever possible to establish correctly by my Presence as a living, breathing, Human Being with a soul together as may be necessary sworn attestations from friends, family, and other associates. Furthermore I claim that this supersedes any necessity to obtain or carry any form of external token such as an Identity Card for any lawful purpose of establishing my true identity for the simple reason that no such token can ever represent the sovereign soul with which I am blessed.

[890] Furthermore, I claim that the courts in The United States of America are de-facto and bound by the Law and Equity Acts and are in fact in the profitable business of conducting, witnessing and facilitating the transactions of security interests and I further claim they require the consent of both parties prior to providing any such services.

[900] Furthermore, I claim all transactions of security interests require the consent of both parties and I do hereby deny consent to any transaction of a security interest issuing under any Act for as herein stated as a Freeman-on-the-Land I am not subject to any Act.

[910] Furthermore I claim ownership of my single share in the corporation known as the UNITED STATES OF AMERICA and demand a copy of said share such that I will become the shareholder and thereby be in the position of exercising my own voting rights. Furthermore I claim to receive the corresponding dividends for as long as said UNITED STATES OF AMERICA operates under the illusion that ‘money has some value’ (notwithstanding the fact that ‘money has no value’ has been admitted by HM Treasury. Evidence of this admission can be supplied, and is anyway publicly available).

[920] Furthermore I claim that my inalienable Natural Right to Trial By Jury for any apparent transgressions on my part, including an inalienable Natural Right of Habeas Corpus, and these shall not under any circumstances be infringed.

[930] Furthermore I claim the right to be entirely free to determine my own medication needs at all times and never under any circumstances be forced to ingest or otherwise receive into my body by way of vaccination, electro-magnetic energy, audio or visual energy or any other method any substance or alien energies I do not consent to accept.

[940] Furthermore, I claim the right to convene a proper court de jure in order to address any potentially criminal actions of any peace officers, government principals or agents or justice system participants who having been served notice of this claim fail to dispute or discuss or make lawful counterclaim and then interfere by act or omission with the lawful exercise of properly claimed and established rights and freedoms.

[950] Furthermore, I claim the right to fulfil my duty to shoot any foreign troops in the United States of America who are armed and attempting to police or govern me or my fellow countrymen without consent and to view them as an invading force which must be lawfully attacked. And I further claim to right to nominate as many deputies as may be necessary who by their own free will and consent are prepared to assist me in fulfilment of this duty to my Country.

[960] Furthermore, I claim the law of agent and principal applies and that service upon one is service upon both.

[970] Furthermore, I claim the right to deal with any counterclaims or disputes publicly and in an open forum using discussion and negotiation and to capture on video tape said discussion and negotiation for whatever lawful purpose as I see fit.

[980] Furthermore, I claim my SCHEDULE for any transgressions by peace officers, government principals or agents or justice system participants or agents of the medical profession or any other parties who trespass upon and thus unlawfully hinder My Peaceful Self, Allen-James: of the Homyak family, as defined in attached Schedule A.

[990] Furthermore I claim the right to use a Notary Public to conduct due process of the aforementioned SCHEDULE against any transgressors who by their actions or omissions harm me or my interests, directly or by proxy in any way. Affected parties wishing to dispute the claims made herein or make their own counterclaims must respond appropriately within FOURTEEN (14) days of service of notice of this action. Responses must be under Oath or Attestation, upon full commercial liability and penalty of perjury and registered at the Place of Claim of Right provided no later than fourteen days from the date of original service as attested to by way of certificate of service. Schedule B is available for the resolution of any objections.

Failure to register a dispute against the claims made herein and then successfully defeating these claims in a proper court of law will result in an automatic default judgment preventing forevermore violation of any rights herein claimed and establishing permanent and irrevocable estoppel by acquiescence barring the bringing of charges under any statute or Act or regulation against My Self Freeman-on-the-Land Allen-James: Homyak for exercising these lawful and properly established rights, freedoms and duties.
